Don't pay a real estate broker to do your contract.  Hire a real estate attorney who offers a flat fee service.  Here's why:

  • Why pay a real estate broker a fee to do a purchase and sale agreement when they cannot give legal advice or interpret the contract and how it affects your rights?  Real estate agents are NOT attorneys, and are NOT permitted to render legal advice.  Doing so constitutes engaging in the unauthorized practice of law (RCW 2.48.180).  In fact, by state law brokers and agents are required to advise their clients to seek legal advice when difficult issues arise.
  • By law, real estate agents are only allowed to fill-in the blanks of pre-printed forms that have been prepared by an attorney; they can’t draft legal agreements for others, including agreements to sell your home.  Again, doing so may constitute the unauthorized practice of law.
  • Real estate attorneys, on the other hand, can provide you not only with legal advice, but also with contract preparation and review services.
  • Many flat fee real estate attorneys can provide these services for between $600 and $900.  Don't be misled by those who claim that your real estate attorney will cost you thousands of dollars.
  • When negotiating with an agent or buyer you can put yourself in a position of strength by having a real estate attorney representing you and givng you timely legal advice.
  • Based on our broker's seventeen years of experience, this is the best advice we can offer.

    If you are not comfortable with the paperwork for your sale, or if you want legal advice before signing a contract, or you want assistance negotiating with buyers or their agents, a flat fee real estate attorney is a great way to go.  If a legal issue arises, as they often do, real estate agents can’t help you and you will have to hire an attorney to solve the problem anyway.

    So why not hire the attorney to help you from the start?  You can avoid most legal issues before they begin, saving you substantial time and money.
