Real Estate Contracts

REAL ESTATE CONTRACT CENTER

What does a seller do when a buyer wants to make an offer?!? After market exposure this is the number one concern for an unrepresented seller. We believe that the real estate transaction should be easy, transparent and seamless. At MLS4owners.com we go the extra step by providing, upon request, not only the Washington REALTORS® statewide standardize purchase and sale agreement, but also the exclusive MLS4owners.com’s Real Estate Napkin™.

Statewide Purchase and Sale Agreement  (for when the buyer has an agent)
This is the standardized form used by most real estate brokers in Washington. We provide a courtesy copy for your review upon request. Become familiar with it because most agents will present offers to you using this form, and the best buyer for your property may be one who chooses to be represented by an agent (agents from more than 500 different brokerages across the state have represented buyers for our customers). Most buyer agents use the statewide form because it protects their rights and is covered by their E&O insurance. It was developed by real estate attorneys working for brokers, REALTOR® Associations and MLS boards. We believe it is the best in the industry for brokers but that many of the terms and conditions are not relevant to contracts between unrepresented parties.

WARNING: Commission disputes with buyer agents could arise if the statewide form is used, as it is designed to ensure that agents get paid the advertised commission.

The Real Estate Napkin™  (for when the buyer does not have an agent)

We have developed an attorney-approved consumer-friendly purchase and sale agreement which we refer to as the Real Estate Napkin™. The Napkin is provided as an exclusive courtesy for use in the private sale of property presently listed with MLS4owners.com. Any other use is strictly prohibited. You may find it useful for the execution of relatively simple transactions in which all parties are ready, willing and able to close a sale. If you are presently listed with MLS4owners.com and do not have a copy of the Napkin, just request one, and we will email you a copy.

The Napkin may be filled in as a computer form or printed out and filled in by hand. Once you have a mutually agreed contract, provide the documents to your chosen escrow provider. They will create escrow instructions to help you close your sale.

The Fine Print
Even a purchase and sale agreement that is written on a napkin is serious business. You should consult with a real estate attorney before using any document pertaining to your sale. MLS4owners.com is not a party to any real estate transaction, has no agency relationship with sellers or buyers, does not maintain a transaction file, and does not warrant the suitability of any purchase and sale agreement for the parties’ intended use. The employees of MLS4owners.com are not attorneys; accordingly they are not permitted to provide legal advice.
